By using the website, www.effect.org, you (referred herein as a website user, customer, or visitor) agree to the following Privacy Policy terms:

1. Overview.  Effect.org (aka “Effect” or “Effect International”) (the Company, We, Us) has the highest respect for privacy and personal information of our users, customers, and visitors. Information that is submitted to this website (site) will be collected, processed, stored, disclosed and disposed of in accordance with applicable U.S. law.  Except as provided in this Privacy Policy, we will not release your personal information without express permission except for purposes of data verification and supplementation or such uses as are described in the Company’s relevant policies.

2. Representations. Effect holds all the necessary licenses, consents and authorizations required to engage in the sale and performance of the programs and services offered on the website.

3. Purpose of Data Collection.  We may log your IP address when you visit the website. The information logged allows us to track a user throughout the visit to the website. We do not use this information to capture demographic or other information; rather, it is used simply in the administration of the website.

4. Permitted Use of Personal Information. There are times when Effect may specifically ask for information about you when you sign up to use a service or participate in an Effect program. We may need certain Personal Information – such as name, user or customer identification, e-mail address, billing address, type of computer, or credit card number – in order to provide that service to you. We may also use that Personal Information to let you know of additional programs or services about which you might be interested, unless you choose not to receive such information. We may contact you via e-mail on a regular basis to advise you of information related to your account or the Company. Other e-mails may be sent from us informing you of updates or changes.

5. No Unauthorized Disclosure to Third Parties. The nature of the website requires us to obtain information about your donations, purchases, and activities related to the website. Information that identifies you personally will not be provided to, sold or disclosed to any third party without your express permission.  We restrict access to your data to our service representatives, who need such access to better serve you.  In addition, we may provide limited access to Company personnel who provide financial, administrative or other services in support of the website and Company. These persons are restricted from using this data in any way other than to provide services to us and you, and may not otherwise disclose or otherwise use the data.

Cookies are alphanumeric identifiers that a Web site can store on a user’s computer hard drive. Our program uses cookies when you log on to your account with your User Name and Password. These cookies allow us to remember you as you visit the website, so that you do not need to reenter your information. Our usage of cookies also allows us to track where users go when they visit the site. We may use this data to deliver targeted information to you and other similar functionality. Appropriate Age of User.  We NEVER request or knowingly collect Personal Information from persons under 18 years of age (“children”).  We do not knowingly use or share Personal Information from persons under 18 years of age with third parties.  We never give children the ability to publicly post or otherwise distribute Personal Information.  We never entice children with the prospect of a special game, prize or other activity to divulge Personal Information.  A primary mission of Effect is to protect children and other innocent persons. We encourage you to participate in your child’s experience on the Internet and to review important safety tips with each child before he or she explores the Internet.

10. Security.  We take commercially reasonable precautions consistent with general industry practices to protect your information. Submitted sensitive payment data it is transmitted directly to our third-party payment service provider, Stripe. Stripe meets PCI-DSS requirements and keeps sensitive data protected.

We protect any other sensitive information both online and off-line. Access to user, customer or visitor information is restricted in our offices. Only individuals who have a need to know such information to perform a specific job (for example, customer service) are granted access to personally identifiable information. Furthermore, all such individuals are kept up-to-date on our security and privacy practices. When an employee is hired, as well as any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and the requirements on them to ensure our users’ information is protected.

You are responsible for maintaining the confidentiality of your account, login, password, and other personal data, and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We ask you not to share a password with anyone.

13. Updates or Changes.  Any changes to this Privacy Policy shall be posted online on our website. Changes shall be considered effective immediately after the changes are posted on this site. The Privacy Policy was last revised on June 15, 2016. If at any point we decide to use personally identifiable information or other information disclosed by you in a manner different from that stated at the time it was collected, we will notify you by email prior to implimenting such change. You will have a choice as to whether or not we use the information in this different manner. Otherwise, we will use information in accordance with the Privacy Policy under which the information was collected.

14. Governing Law, Jurisdiction & Venue. This Privacy Policy is governed by and shall be construed in accordance with the laws of the state of Utah. Any dispute brought hereunder must be done exclusively in a Utah forum under Utah’s applicable jurisdiction and appropriate venue.
